Disability Tests: Finding a Fix for the FCE
- Rich Podell, MD - The CFIDS Chronicle, Fall 2002
"There is a desperate need to create a forum to develop a new disability
assessment paradigm. Clinicians, disability attorneys and insurers, and
rehab and occupational therapists should work together to define new
methods of assessing function in chronic conditions. This would be a
great service to patients with these illnesses, as well as the
professionals they rely on to document their disability."

"
I have successfully assisted numerous clients with fibromyalgia in the past and am very familiar with the criteria used by Social Security to evaluate the claims for disability. [One recent] client indicated that they had participated in a support group early in their diagnosis and found it very beneficial in terms of the information it provided.
I have almost 15 years experience in Social Security Disability law. I handle all aspects of the application process from Initial Claim through the Hearing level and even to the Appeals Council. I conduct the initial claimant interview, request and obtain medical evidence, extensively review and submit evidence to the Administrative Law Judge (ALJ), and carefully analyze facts in light of the regulations.
I am familiar with orthostatic intolerance and how it is viewed by Social Security. In fact, I have assisted a few clients who underwent a tilt-table test (TTT) in order to provide more definitive findings for the ALJ handling the hearing process. The ALJ was more persuaded with the testing results and how it interacts with the criteria for both CFS and Fibromyalgia.
I would be happy to speak with anyone who may have questions about Social Security disability and how to navigate the application process."
